The following terms apply for shipping within the Federal Republic of Germany. Supplies within the European Union (EU) and other foreign countries are governed by special EU shipping terms and shipping terms for abroad, respectively.
Prices
1. As a general rule, catalogue prices become invalid once the new catalogue appears. Prices are subject to change. Please pay particular attention to our information in the monthly issue of "jazz-network.com newsletter" as well as limited offers. In the event of a price increase, you as our customer are not bound to your order. All prices indicated include statutory value added tax.
2. Shipping and handling costs are free for orders with a minimum order value of EUR 99,00. Orders below this value are subject to a shipping and handling fee of EUR 3,50.
Please note that order volumes decrease if goods are returned. We retain the right to levy the dispatch flat rate retrospectively.
3. If the order value for the below legal right of withdrawal for consumers is more than 40 EUR, we will reimburse you for the return shipping costs. If the order value is less than 40 EUR, then the consumer must pay the return shipping, unless the goods delivered were not the goods ordered.
Your right to cancel in accordance with the law governing remote sales
The following right to cancel does not apply for sealed goods (audio recordings, video recordings, software on all kinds of data carriers) if you open or damage (unseal) the packaging.
Titles specially procured for you in accordance with your specifications are excluded from this right to cancel.
Indicated by the following reference: "Eigenimport ohne Rückgaberecht" ("Special import without return privilege").
You are no longer bound to your order if you cancel it within 2 weeks of receiving the goods. Cancellation need not include an explanation but must be made in writing on a permanent data carrier or by returning the actual article. Maintenance of this deadline means timely dispatch of your cancellation to jazz-network.com [A Division of LeiCom GmbH], Hohnerstr. 23, D - 70469 Stuttgart .
In the event of a cancellation, we will remunerate any payments already received upon receipt of the returned merchandise. You are obliged to return to us the goods - for which the risk will be borne by us - if you have not already done so when sending us your letter of cancellation.
You will be responsible for bearing the costs of returning the goods if the value of the merchandise ordered and being returned does not exceed 40 EUR.

Information on Returning Merchandise:
1. If damaged or used goods are returned, jazz-network.com shall be entitled to claim for compensation (§ 361a II, German Civil Code).
2. Please affix the correct stamps to returned merchandise. Please note that we will refuse to accept deliveries which have not been stamped. In the case of courier deliveries and other irregular means of dispatch, we will under no circumstances accept costs which exceed those of sending the delivery by post. Packs or sets must be returned in full.
If applicable, a credit note will be credited to your customer account or the costs of returning the goods will be remunerated in another way.
Payments, Deliveries
1. In the case of deliveries within Germany, orders are usually dispatched by post from our warehouse within one week of receiving your order. Orders for special titles from abroad may take 2 - 4 weeks. Delivery is subject to us being provided with the correct goods in time and we are thus not responsible for the unavailability of goods. There shall be no compensation made unless delays are intentional and grossly negligent on our part.
We retain the right to supply limited articles in standard quantities only.
2. Deliveries shall be paid immediately upon receipt of invoice and without any deductions. In the event that you provide us with an automatic debt transfer, we will debit the sums due from your account on the 1st of the month. We do not accept liability for losses when sending cash or cheques.
3. If your payments are overdue, we retain the right to levy interest on defaulted payments amounting to 5% higher than the respective basic interest rate announced by the Deutsche Bundesbank (www.bundesbank.de). You will retain the right to provide evidence that we have not incurred any or only minimum damage caused by delayed performance.
Reservation of Ownership
The goods supplied shall remain our property until such a time as payment has been submitted in full. Until then, you are obliged to take care of the goods and to report any damage without delay. In the event of a default in payment, we shall be entitled to withdraw from the contract and demand return of the goods. Costs for returning goods in the event of a default in payment (upon expiry of the cancellation deadline) must be borne by you and must be remunerated if you did not pay for shipping them in the first place.
Data Protection
We will store and use your data for dealing with the contents of the contract only (if necessary with affiliated companies and for checking creditworthiness). It goes without saying that your personal details will be treated confidentially. You can cancel your free customer information (newsletter etc.) at any time by simply notifying us in writing.
Place of Performance, Place of Jurisdiction, Partial Invalidity, Applicable Laws
1. The place of performance for all reciprocal services indicated in the contract including any claims to reimbursement shall be Stuttgart.
2. In business transactions with merchants and legal persons under public law, the place of jurisdiction for all legal disputes arising from the contract, including actions on dishonoured bills or cheques, shall be Stuttgart; we shall also be entitled to sue customers wherever the latter are based.
3. If any individual specifications of the delivery contract or these general shipping terms are or become invalid, this shall not affect the validity of the remaining specifications.
4. The laws of the Federal Republic of Germany shall apply for legal business or other legal relations with jazz-network.com [A Division of LeiCom GmbH]. For contracts with an objective which can not be assigned to the consumer's professional or commercial activity, these laws shall only apply in as far as protection provided by mandatory provisions of the law in the country in which the consumer usually resides has not been revoked.
